In Game Payment Terms
These In Game Payment Terms (“Terms”) apply to your use of In Game Payment features which allows Facebook users (“Users”) to purchase digital goods inside of a game experience hosted by Facebook.
Your use of the In Game Payment features is subject to, and you agree to comply with the (a) Payments Terms, currently available at https://developers.facebook.com/policy/payments_terms, subject to the revisions provided below, (b) Monetization Eligibility Standards currently available at https://www.facebook.com/help/publisher/169845596919485, and (c) Content Guidelines for Monetization currently available at https://www.facebook.com/help/publisher/content-guidelines.
The following language is added as a new Section 7.1(b)(i) of the Developer Policies:
"Company hereby:
a. Authorizes Facebook to sell licenses of certain digital goods made available within the Games ("Digital Goods") within the Facebook Products; and
b. Grants Facebook a license to reproduce, distribute, perform, and display the Digital Goods to persons who have purchased licenses to such Digital Goods."
The following revisions are made to the Payments Terms:
All references to "Developer Balance" are deleted and replaced with "Developer Revenue Share."
Section 1.2 (Roles of Parties) of the Payments Terms is deleted and replaced with the following:
"Roles of Parties. You accept responsibility for fulfilling each transaction upon confirmation that the payment for that transaction has been completed successfully. Facebook will sell licenses to your digital goods, with payments processed through Facebook’s payment systems or the applicable mobile platform's ("Mobile Platform") in-app payment functionality."
Section 2.1 (Developer Balance) of the Payments Terms is deleted and replaced with the following:
"Developer Revenue Share. Developers using Facebook Payments will have a Developer Revenue Share with Facebook. Whenever Facebook processes a sale of your digital goods in a game within the Facebook Products, Facebook will credit the proceeds from that sale to your Developer Revenue Share, less any Mobile Platform fees (e.g., Google thirty percent (30%) service fee), Facebook service fees, deductions for fraud, bad debt, chargebacks, refunds, credit card processing fees, and any other third-party fees. Facebook may charge a service fee of up to 30% for each sale. Additionally, Facebook will withhold any sales, use, turnover, withholding or value added tax, where applicable, from each disbursement for any Facebook Payments transaction subject to these Terms."
Section 2.3(3) of the Payments Terms is deleted and replaced with the following:
a. "Facebook will redeem your Developer Revenue Share approximately 60 days following the end of the month in which the transaction occurred, except as otherwise set forth herein."
In Game Payments is part of the "Facebook Products" under Facebook's Terms of Service (https://www.facebook.com/terms.php, the "Terms of Service"). In the event of any express conflict between these Terms and the Terms of Service, these Terms will govern solely with respect to your use of in Game Payments and solely to the extent of the conflict.
